Is Test and Tag Mandatory in the NT? | Safeway Test & Tag
Is test and tag mandatory in the NT? It is one of the first questions Territory businesses ask us. The honest answer is that for a lot of workplaces, yes, it is required by law. For the rest, it is the simplest way to show you are meeting your duty of care. Here is what the rules actually say, without the jargon.
What the law says
In the NT, workplace safety falls under the Work Health and Safety (National Uniform Legislation) Act 2011 and its regulations. Regulation 150 is the one that covers test and tag.
It says a business must make sure electrical equipment is regularly inspected and tested by a competent person when both of these are true:
•The equipment is plugged into a power socket.
•It is used somewhere that normal use is likely to damage it or shorten its working life.
That second point is what people mean by a hostile environment.
What counts as a hostile environment
The regulations point to conditions such as moisture, heat, vibration, mechanical damage, corrosive chemicals and dust. In practice that covers a large part of the working Territory:
•Construction and demolition sites
•Workshops, factories and warehouses
•Commercial kitchens
•Mining and remote sites
•Cleaning businesses, and anywhere equipment is carried from job to job
•Outdoor work, where heat, humidity and dust are part of every day
If your equipment is used in any of those, testing is not optional. It is a legal requirement.
What if you work in an office?
A quiet office with computers that never move may not fall directly under Regulation 150. But every NT business still has a general duty to provide a safe workplace, and electrical equipment is part of that.
If something fails and someone is hurt, the first question will be what you did to check it. A current test and tag record is the clearest answer you can give.
AS/NZS 3760:2022 is not law on its own. It is the Australian standard the regulations refer to, and it is what inspectors and insurers expect to see followed.
Who is responsible
The duty sits with the person conducting the business or undertaking. In plain terms that means the business, not the individual worker.
If you hire equipment in, you are still responsible for making sure it has been tested for the hire period. If you are a subcontractor on someone else's site, expect the principal contractor to ask for your records before you plug anything in.
Who can do the testing
The regulation says a competent person. That means someone with the training and experience to inspect and test equipment properly and read the results correctly. Owning a tester is not the same thing. Getting it wrong can mean passing something that is not safe.
What happens if you do not test
If equipment that should have been tested causes an injury or a fire, the business can face penalties under WHS law, and an insurer may look closely at any claim.
More to the point, test and tag exists because damaged leads and faulty tools hurt people. A frayed cord in a humid workshop is exactly the kind of thing a test picks up before it turns into an incident.
Frequently asked questions
Does every workplace in the NT need test and tag?
Every workplace using equipment in a hostile environment does, under Regulation 150. Lower risk workplaces are not covered by that regulation directly, but testing is still the most practical way to meet the general duty to keep people safe.
Is AS/NZS 3760:2022 the law?
Not by itself. It is the Australian standard that sets out how to inspect and test equipment, and the NT regulations refer to it. Following it is how you show you have done what the law asks.
How often does equipment need to be tested?
It depends on the environment, from every three months on construction sites to every five years for equipment that never moves. Our guide to how often you need to test and tag in the NT breaks it down by workplace.
